End User Agreement
This the agreement (Agreement) between you, the customer who has acquired the PremiumizeVoip application (“You”) and Nokotek Limited (“PremiumizeVoip”).
PremiumizeVoip is only willing to provide PremiumizeVoip to you on the condition that you accept all of the terms contain in this Agreement.
You accept all of the terms by installing or using PremiumizeVoip. If you are unwilling to accept this Agreement, do not use PremiumizeVoip.
1. OWNERSHIP
PremiumizeVoip is a service. There are no implied licenses under this Agreement.
2. GRANT OF LICENSE
This agreement grants you the limited right to install and use PremiumizeVoip app for its designed purpose - which is mainly local and international calling.
3. OTHER RIGHTS AND LIMITATIONS
You may not reverse engineer, decompile, or disassemble the PremiumizeVoip application. PremiumizeVoip may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the App and all of its component parts.
4. NO EMERGENCY CALLS
This is important! An emergency call is one of the most important calls you will ever make. We care about your safety but PremiumizeVoip is not intended to support any emergency calls of any kind. PremiumizeVoip is not a traditional telephone service. In particular, PremiumizeVoip does not allow you to make emergency calls. Please consider this and ensure you have other means of communication to contact emergency services!
5. REFUNDS
You may request a refund for unused credits by submitting a written request in English to PremiumizeVoip’s customer services at support@PremiumizeVoip.com within 30 days of the original payment. Refund request submitted through other means shall not be eligible for the refund. PremiumizeVoip reserves the right to refuse a refund request if it reasonably believes (i) that you are trying to unfairly exploit this refund policy; (ii) if you are in breach of these Terms or (iii) if PremiumizeVoip reasonably suspects that you are using our Products or Software fraudulently or that your User Account is being used by a third party fraudulently.
If you believe that PremiumizeVoip has charged you in error, you must contact PremiumizeVoip within 30 days of such charge by submitting a written request in English to our customer services at support@PremiumizeVoip.com. Refund request submitted through other means shall not be eligible for the refund. No refunds will be given for any charges more than 90 days old.
6. EXPIRATION OF CREDITS
Credit balances that are not used within the last 12 month period since a payment will expire and be lost.
7. CALL RATES
When you purchase a package You are purchasing VoIP balance. The calling rates itself are subject to change. Make sure to check the published rates regularly.
8. INFORMATION RETENTION
PremiumizeVoip is not responsible for retention of any of the information required for the use of the service and is under no obligation to retain such information. We dispose all logs, call information and payment information as soon as they do not have a purpose anymore, e.g. credits expired, calls successfully billed, etc.
9. NO LIABILITY FOR CONSEQUENTIAL DAMAGES
In no event shall PremiumizeVoip be liable for any damages whatsoever (including but not limited to damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) which results from the use or inability to use PremiumizeVoip, the PremiumizeVoip website or any other PremiumizeVoip application, even if PremiumizeVoip has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of consequential or incidental damages, the above limitations may not apply to you.
10. GOVERNING LAWS
The laws of Hong Kong, excluding its conflicts of law rules, govern this Agreement and your use of our products and website.
11. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL NOKOTEK LIMITED, ITS AFFILIATES, PARTNERS OR PROVIDERS BE LIABLE FOR PERSONAL OR PROPERTY INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE PremiumizeVoip PRODUCT(S) OR THE PremiumizeVoip WEBSITE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF PremiumizeVoip HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. GENERAL PROVISIONS
If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of this Agreement, which shall remain valid and enforceable according to its terms. This Agreement shall not prejudice the statutory rights of any party dealing as a consumer except to the extent permitted by applicable consumer laws. This Agreement may only be modified by a writing signed by an authorized officer of PremiumizeVoip. Updates may be licensed to you by PremiumizeVoip with additional or different terms. This is the entire agreement between PremiumizeVoip and you relating to PremiumizeVoip products and it supersedes any prior representations, discussions, undertakings, communications or advertising relating to PremiumizeVoip or any PremiumizeVoip product.
